PART 5 — DISPUTE RESOLUTION, MANDATORY ARBITRATION, CLASS ACTION WAIVER & ENFORCEMENT

62. PURPOSE & GOVERNING PRINCIPLES
This Part establishes the exclusive dispute resolution framework applicable to all claims, disputes, or controversies arising out of or relating to:
- These Terms and any incorporated policies
- Use of the Platform
- Transactions, Digital Goods, or Services
- Alleged violations of law, contract, or rights
GPDS GAME SHOP adopts this framework to promote efficient, predictable, and cost-effective resolution while preserving mandatory consumer protections.
63. INFORMAL DISPUTE RESOLUTION (MANDATORY FIRST STEP)
63.1 Good-Faith Resolution Requirement
Before initiating arbitration or legal proceedings, Users agree to first contact GPDS GAME SHOP support and attempt to resolve the dispute informally.

- Full name and Account identifier
- Description of the dispute
- Relevant transaction details
- Relief sought
63.2 Resolution Period
GPDS GAME SHOP shall have thirty (30) calendar days from receipt of the notice to attempt resolution.
Failure to complete this step may result in dismissal or suspension of any arbitration or legal claim, where permitted by law.
64. MANDATORY BINDING ARBITRATION
64.1 Arbitration Agreement
Except where prohibited by applicable law, all disputes shall be resolved exclusively by final and binding arbitration, not by court proceedings.
This includes claims based on:
- Contract
- Tort
- Statute
- Consumer protection laws
- Fraud or misrepresentation
64.2 Arbitration Administrator
Arbitration shall be administered by a recognized arbitration institution, selected based on jurisdictional relevance, which may include:
- Philippine Dispute Resolution Center, Inc. (PDRCI)
- American Arbitration Association (AAA)
- International Chamber of Commerce (ICC)
- London Court of International Arbitration (LCIA)
- Japan Commercial Arbitration Association (JCAA)
64.3 Seat, Language & Rules
- Seat: Determined based on User location and applicable law
- Language: English, unless otherwise required by law
- Rules: The rules of the selected arbitration institution
64.4 Authority of Arbitrator
The arbitrator shall have exclusive authority to:
- Determine jurisdiction
- Interpret and apply these Terms
- Grant remedies permitted by law
The arbitrator may not award relief on a class, collective, or representative basis.
64.5 Finality & Enforcement
The arbitral award shall be:
- Final and binding
- Enforceable in any court of competent jurisdiction
Awards may be enforced under the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
65. CLASS ACTION & REPRESENTATIVE ACTION WAIVER
65.1 Waiver
To the fullest extent permitted by law, Users waive the right to:
- Participate in class actions
- Participate in collective or representative actions
- Act as a private attorney general
All disputes must be brought solely in an individual capacity.
65.2 Severability
If the class-action waiver is found unenforceable in a particular jurisdiction:
- The waiver shall be severed only to the extent required
- The remainder of the arbitration agreement remains enforceable
66. EXCEPTIONS TO ARBITRATION
66.1 Small Claims
Users may pursue individual claims in small-claims court where:
- Jurisdictional limits apply
- The claim remains individual
66.2 Injunctive & Equitable Relief
GPDS GAME SHOP may seek injunctive or equitable relief in court to protect:
- Intellectual property
- Confidential information
- Platform security
67. LIMITATION PERIOD FOR CLAIMS
To the maximum extent permitted by law, any claim must be brought within one (1) year from the date the claim arises.
Claims brought after this period are permanently barred.
68. GOVERNING LAW
Disputes shall be governed by the laws applicable to the User’s location, without regard to conflict-of-laws principles:
- Philippines: Laws of the Republic of the Philippines
- United States: Applicable federal and state laws
- United Kingdom: Laws of England and Wales
- Japan: Laws of Japan
Mandatory consumer protections remain unaffected.
69. COSTS & FEES
Each party shall bear its own legal fees unless otherwise required by law or awarded by the arbitrator.
Arbitration fees shall be allocated in accordance with applicable arbitration rules and consumer-protection requirements.
70. SURVIVAL
This Part survives:
- Account termination
- Platform discontinuation
- Expiration of these Terms
PART 6 — COUNTRY-SPECIFIC LEGAL ANNEXES
GPDS GAME SHOP
The following annexes apply only to Users located in the specified jurisdictions and supplement Parts 1–5.
Where a conflict exists, the relevant Annex prevails to the extent required by mandatory local law.
ANNEX A — EUROPEAN UNION (EU / EEA)
A1. GDPR COMPLIANCE
Personal Data is processed in accordance with Regulation (EU) 2016/679 (GDPR).
EU Users have rights including:

- Rectification
- Erasure
- Restriction
- Portability
- Objection
Requests are processed within legally mandated timeframes.
A2. DIGITAL GOODS & RIGHT OF WITHDRAWAL
Under EU consumer law, Users expressly acknowledge that:
- Digital Goods are delivered immediately
- The right of withdrawal is waived once delivery begins

B2. COPPA
Children under 13 years old are prohibited from using the Platform.
GPDS GAME SHOP does not knowingly collect children’s Personal Data.
B3. FEDERAL ARBITRATION ACT
The arbitration agreement is governed by the Federal Arbitration Act (FAA) to the fullest extent permitted by law.
ANNEX C — UNITED KINGDOM
C1. UK GDPR
Personal Data is processed in accordance with UK GDPR and the Data Protection Act 2018.
C2. AGE-APPROPRIATE DESIGN CODE
GPDS GAME SHOP aligns with the UK ICO’s Age-Appropriate Design Code, including high-privacy defaults for minors.
C3. CONSUMER RIGHTS
Nothing in these Terms limits statutory rights under the Consumer Rights Act 2015.
ANNEX D — JAPAN

Personal Data is processed in accordance with the Act on the Protection of Personal Information (APPI).
D2. DISCLOSURE & CORRECTION RIGHTS
Users in Japan may request:

D3. SPECIFIED COMMERCIAL TRANSACTIONS ACT
Digital Goods delivered immediately are not subject to cooling-off, except where required by law.
